Nevada Business Licenses: Now processed through Secretary of State's Office

Effective October 1, 2009, Nevada state business licenses will be processed through the Secretary of State’s office as opposed to the Department of Taxation, as they have been in prior years. If your entity is required to have a state business license, beginning October 1, 2009, it will be necessary for you to complete and file a Business License Application with the Secretary of State’s office and pay for the license through that office. (Business License application can be located HERE). The license fee is $200 and the application should be filed on an annual basis concurrently with your company’s annual list of officers/directors/members.

If your company has a current state business license and it is due to expire before the date on which your company’s next annual list of officers/directors/members is due, you should still file for a state business license upon expiration of the current license. Upon filing of your company’s next annual list, you will re-file for the state business license and pay a prorated fee at that time. On a going forward basis, the annual list and the business license will have the same annual renewal date.

If your company has a current state business license and it is due to expire after the date on which your company’s annual list of officers/directors/members is due, you should file the application for state business license at the time the annual list is filed. You will receive a credit for any months remaining on your current business license. On a going forward basis, the annual list and the business license will have the same annual renewal date.

Penalty for failure to timely pay the annual fee is $100. However, there is a penalty grace period through January 31, 2010. Effective February 1, 2010, all delinquent licenses will be assessed the penalty fee.
